Terms of Service

These terms govern your use of the Nextly mobile app ("Nextly"), provided by Petalform LLC ("we", "us"). By using Nextly you agree to these terms and to the Nextly Privacy Policy. If you don't agree, please don't use the app.

What Nextly is (and isn't)

Nextly is a planning and record-keeping tool for your own career development. AI suggestions, reviews and drafts are generated automatically from what you provide; they can be incomplete or wrong, and they are not career, hiring, employment, legal or financial advice. Nextly does not predict or guarantee promotions, job offers, interviews or hiring outcomes, and progress percentages describe your own plan, not your chances. You decide what to accept, edit, submit or rely on.

Your account

You need a Nextly account (an email code, or Sign in with Apple on iOS) to save your plan, and you're responsible for access to your email and devices. Sign-in is provided by Petalform LLC's shared sign-in service, as described in the privacy policy. You must be at least 16 years old, or older if your country requires it.

Your content and your employer

You own what you add to Nextly. You give us permission to store and process it, including sending it to our AI providers (Anthropic, with Google as a backup) when you use a feature that analyzes it, unless you've turned AI analysis off, only to provide Nextly to you. Only add material you're allowed to share: don't upload confidential or proprietary employer information, other people's personal data, or job postings or frameworks you don't have the right to use.

Job-posting links

When you give Nextly a link, our server fetches that public page once for you. Don't submit links to pages you aren't allowed to access, or to sites whose terms forbid automated access; Nextly refuses some of these automatically.

Generated drafts

Self-reviews, promotion cases, resume bullets and similar drafts are starting points built only from your own evidence. Check them before using them anywhere. You're responsible for what you submit to an employer or anyone else.

AI features

Nextly's AI features are provided through Anthropic's Claude API, with Google's Gemini API as a backup. AI suggestions can be wrong or incomplete; they're labeled, and they never change your plan unless you accept them. Don't submit information you aren't permitted to share.

Reporting AI content

Use "Report a problem" in the app to flag AI content that's inaccurate or harmful. We review reports but may not respond to each one individually.

Fair use and limits

The free plan and Nextly Pro include AI analysis up to the limits shown in the app. We may rate-limit or suspend automated or abusive use.

Nextly Pro subscriptions

Nextly Pro is an optional auto-renewing subscription, offered monthly or annually at the price shown in the app.

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
• Manage or cancel your subscription in your Apple ID or Google Play account settings. Deleting your Nextly account or the app does not cancel your subscription.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
• Refunds are handled by Apple or Google under their policies.

Acceptable use

Don't misuse Nextly: for example, don't try to access other people's data, disrupt or reverse-engineer the service, overload it with automated requests, or use it to break the law.

Changes and availability

We may change, suspend or discontinue features. We will try to give notice of significant changes. We may update these terms; continued use after an update means you accept the new terms.

Termination

You can delete your Nextly account at any time (Profile → Account → Delete my Nextly account). We may suspend or end access if you seriously or repeatedly break these terms.

Disclaimers

Nextly is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. You are responsible for your own career decisions.

Limitation of liability

To the fullest extent permitted by law, Petalform LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, employment or opportunities, arising from your use of Nextly. Our total liability for any claim is limited to the amount you paid for Nextly in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.

App stores

If you downloaded Nextly from the Apple App Store, you also agree to Apple's Licensed Application End User License Agreement, and Apple has no obligation to provide support for the app. Downloads from Google Play are also subject to Google Play's terms.
